Vigil and are original artworks and are strictly prohibited from any copying, reproductions, or distribution of any form that would include any sales that would suggest anyone other Magnetarz LLC owning all original digital artworks, without permission or a contractual agreement is in place. Magnetarz’ horse and jockey logo is a registered No. 4,666,480 trademark with the USPTO, and any derivation for the purpose of Magnetarz’ magnetic horse racing game use such as the race tickets of the registered trademark are also owned by Magnetarz-LLC. All are strictly prohibited from any copying, reproduction, or distribution in any form, that would include any sales or suggest that any others have any legal rights to Magnetarz art, logos, and intellectual and design properties without permission and would be considered infringement of all of the above-owned properties.

Magnetarz’ artist and digital art collections and images are original works of art that were designed and created by Mona Pardo aka Ramona Pardo aka Ramona I. Pardo aka Mona Vigil aka Ramona Vigil aka Ramona I. Vigil  and are considered copy written. Therefore it is unlawful to reproduce, copying through any measures, selling of any illegal printing is unauthorized without contractual agreement and is strictly prohibited.

CONTRACTUAL PERMISSION - LICENSING

Magnetarz’, owns all intellectual and design properties, digital artworks, within Magnetarz.com aka Derbiogame.com website, and has the right to agree upon and authorize a contract between other retailers or legally owned businesses who are interested in retailing Derbio International magnetic tabletop game, digital art collections and or solo digital images and or any other artworks created with other mediums. It is then recommended that interested merchants, retailers, online store and or legally owned businesses, licensors to then contact Magnetarz’ through email of such inquiries so that a contractual agreement, legalities and permission(s) can be agreed upon.  These legally binding contracts would then provide duration of length of timeline permission(s) of these contractual permissions between Magnetarz and interested merchants, retailers, online store and or licensors. ALCOHOL CONSUMPTION

Likewise, Magnetarz is NOT RESPONSIBLE OR LIABLE and will not be held accountable for any misuse or overuse of alcohol consumption by legal aged adults who do not drink responsibly or choose to drive under the influence of alcohol, and choose not to use a Taxi or Uber for transportation to their destination.  Should a host provide alcohol beverages, it is the responsibility of the host to take full responsibility of ensuring each guests drinks responsibly and is offered adequate transportation, when there evidence or reason to believe that they are under the influence of alcohol and should not get behind the wheel of vehicle when departure of the location or where the organized event is being held. Leaving it to the host, to take full responsibility to provide or order a taxi and or Uber for any guest for any of the reasons listed or any other reason that may apply and unknown to Magnetarz. Therefore Magnetarz will not be held accountable or liable for any hosts’, guests or participants at any organized gaming events who do not drink responsibly and get behind the wheel of a vehicle under the influence of alcohol during the duration of the gaming event or thereafter and cause a car accident and harm to passengers or themselves and result in death within the vehicle they are driving or other drivers on the road and cause harm or result in death.  In conclusion, each host should take all the necessary precautions when hosting a gaming event and should provide adequate transportation for misuse of alcohol consumption or any other given reason. It is also recommended that a host suggest on the invitation of the event for each guest to plan accordingly, should they decide to consume alcohol during the gaming event and have a designated driver and non-alcoholic-drinker, or decide upon using a taxi or Uber in place prior to the event, who will then be responsible for transportation for those who choose to drink alcoholic beverages. That would help alleviate of headaches for the host and guests as well as allowing both to focus on the gaming event rather than unfortunate, irresponsible and miscommunications prior to the organized gaming event and or what should be common knowledge for responsible and legal age alcohol responsible drinkers who should already have taken a drivers course and have a legal drivers license in place and full knowledge of not to drive under the influence of alcoholic beverages. When doing so they should either take time to drink coffee allow enough time to pass after the consumption of any alcoholic beverages in order to know when they would not be consider a dangerous or threat to other drivers on the road as well as themselves and would not be considered drunk should they be given a breathalyzer by law enforcement and take full responsibility for their actions.

ALL OF MAGNETARZ OWNED, DIGITAL ARTWORKS SENT TO ANY THIRD PROVIDER, VENDOR OR SUPPLIER, WHERE A DIGITAL FILE IS SENT THROUGH ELECTRONICALLY, SUCH AS EMAIL LINKS, USB’S, CELL PHONES THROUGH ANY MEASURES, AND OR TRANSFERS A DIGITAL FILE TO ANY BUSINESS WITH THE INTENTION IN WHICH THE BUSINESS OR THIRD PARTY VENDOR, RETAILER, SERVICE PROVIDER INDICATES OR REPRESENTS THEIR SERVICE, SHALL NOT DEFER FROM ANY LEGAL USE OR MISCONDUCT AND THE AGREED UPON CONDITIONS FOR THE USE OF MAGNETARZ OWNED PROPRIETARY DIGITAL ART WORKS AND FILES.

MAGNETARZ WILL NOT BE RESPONSIBLE FOR ANY CONSEQUENTIAL LOSS OF PROFITS, DUE TO ANY NETWORK OUTAGES, POWER OUTAGES, WHERE MAGNETARZ WEBSITE IS DOWN AND LOSS CONNECTION, INABILITY THE USE OF THE MAGNETARZ WEBSITE, OR FOR ANY REASONS FOR DURATION OF UNEXPECTED OCCURRENCES FOR ANY REASON WHATSOEVER. TO ANY THIRD PARTY VENDOR, SERVICE PROVIDER, OR RELATED SERVICES WHO MIGHT INDURE LOSS OF PROFITS, DURING SUCH UNEXPECTED AND UNPREDICTABLE OCCURRENCES.  MAGNETARZ WILL PROVIDE ADEQUATE INFORMATION, SHOULD THE MAGNETARZ WEBSITE BE DOWN WHILE UNDER CONSTRUCTION, HOWEVER WILL MAKE EVERY EFFORT TO AVOID SUCH OCCURRENCE.

ANY DISSATISFIED VIEWERS, CONSUMERS, CUSTOMERS, VENDORS, SERVICE PROVIDERS, RETAILERS, BUSINESSES, MERCHANTS WHO ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF MAGNETARZ TERMS AND CONDITIONS AND THE USE OF THE MAGNETARZ WEBSITE.  YOU TAKE RESPONSIBILITY TO DISCONTINUE USING THE SITE AND DO NOT HOLD MAGNETARZ LIABLE FOR YOUR DECISION.

TERMINATION/ACCESS RESTRICTION

Magnetarz reserves the right, in its discretion, to terminate your access to the site and the related services or any portion thereof at any time, without notice if there are concerns of negligence to the Magnetarz website.  To the maximum extent permitted by law, the laws of the State of Colorado govern this agreement and you hereby consent to the exclusive jurisdiction and courts of Colorado in all disputes arising out of or relating to the use the site.  Use of the site is in any jurisdiction you acknowledge compliance to all applicable laws and all provisions therein Magnetarz Terms and Conditions including, without limitation this section. 

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Magnetarz as a result of this agreement or use of the site.  Magnetarz strictly enforces the agreement is subject to existing laws and legal process in this agreement and will comply with governed court and law requirements relating Magnetarz request of termination or your use of this site, should there be any misrepresentation of there being any business or partnership relationship when visiting the Magnetarz website.

LEGAL AUTHORIZATION

Magnetarz respectfully agrees and constitutes the entirety of this agreement unless otherwise specified herein and it supersedes all prior or contemporaneous communications should there any agreed upon licensing and authorized legal permissions for Magnetarz owned copy written proprietary, design and intellectual properties digital art. Where there is consent and legal authorization from Magnetarz, where there applicable knowledge of the intent and use of the digital art files, Derbio International content and a legal contract is in place and authorized timeline.

This would include printed copies for all parties in agreement to the terms and conditions of the contractual legal authorization. There shall not be any deferment from the agreed and signed documentation provided to all parties involved, unless there is legal agreement for unknown unexpected reasons arise during the duration of the contract and all parties agree to terminate the contract and legal signatures are signed by all parties involved.

For both agreed upon legal authorization contracts for the use of any of Magnetarz copy written, proprietary, design and intellectual properties, AND OR a early agreed upon termination of contract for unexpected life occurrences. It is mandatory that there are legal signatures from all parties involved, and current notary for all agreed documentation.

CHANGE OF TERMS AND CONDITIONS

Magnetarz reserves the right, in its sole discretion, to change the Terms under which Magnetarz is offered.  The most current version of the Terms will supersede all previous versions and will offer changes as needed as things progress or for new developments.  Magnetarz encourages you to periodically review our Terms and Conditions to stay informed of our improvements.
